1. Information We Collect
To provide our services, we may process:
- Account information (e.g., phone number, login identifiers)
- Device information (e.g., device ID, OS version, push token)
- Usage data (e.g., feature usage, order history, logs)
- Content you submit (e.g., images, prompts, templates)
2. How We Use Information
We use information to:
- Provide and improve generation, editing, and subscription features
- Confirm orders, grant entitlements, troubleshoot issues, and protect security
- Provide support, notifications, and product improvements
3. Subscription and Payment Data
Payments are processed by Apple App Store. We do not directly store your full card details. We receive necessary order and transaction identifiers and subscription status for entitlement management.
4. Storage and Security
We implement reasonable safeguards to reduce risks of unauthorized access, leakage, and tampering. No transmission or storage method is absolutely secure.
5. Face Data and Biometric Information
ImageCap does not collect, use, store, or share face data as biometric information. We do not perform facial recognition, facial analysis, identity verification, face authentication, biometric processing, or create face templates, face geometry, facial landmarks, faceprints, or biometric identifiers.
Users may voluntarily upload images to use image generation or image editing features. These images may incidentally contain faces. Any faces appearing in user-submitted images are processed only as part of the image content needed to provide the editing or generation result requested by the user. We do not use such images to identify a person, verify identity, analyze facial characteristics, or create any biometric profile.
When necessary to provide the requested feature, uploaded images may be sent to third-party AI service providers solely to process the user's image generation or editing request. These service providers are contractually required not to retain, use, or disclose the images for any other purpose.
User-uploaded and generated images are retained only as needed to provide the app's functionality and according to the user's choices. Users can choose whether to keep or delete their uploaded and generated images, and the app provides deletion controls for removing these images.
6. Sharing
We do not sell your personal data. We may share data only when:
- You authorize us
- It is required by service providers under confidentiality obligations
- Required by law, regulation, or legal process
7. Local Data and Guest Mode
Guest mode data is primarily stored on your device. You can clear cached guest data via "Clear Local Data." Cleared data may not be recoverable.
8. Your Rights
Subject to applicable law, you may request access, correction, deletion of certain data, or account deletion. Notification permissions can be managed in system settings.
9. Children
If you are a minor, please use the service with parent or guardian consent and supervision.
10. Policy Updates
We may update this Policy. Continued use after updates means you have reviewed and accepted the updated version.
11. Disclaimer
ImageCap uses third-party AI models to provide image generation and editing services. Generated results are produced automatically by AI models. We do not guarantee the accuracy, completeness, or legality of any generated content. Users are solely responsible for evaluating the suitability of generated content and assume full liability for its use.
To the maximum extent permitted by law, we are not liable for any direct or indirect losses, disputes, or legal liabilities arising from the use of content generated through this service.
When using generated content for commercial purposes (including but not limited to advertising, product packaging, social media marketing, print publishing, brand promotion, etc.), users must independently ensure that such content does not infringe upon any third party's intellectual property rights, likeness rights, reputation rights, or other legal rights, and must comply with all applicable laws and regulations in their jurisdiction. Any infringement disputes, financial losses, or legal liabilities arising from the commercial use of generated content are borne solely by the user. We assume no joint or secondary liability.
We reserve the right to intercept, restrict, or terminate service for generation requests that violate platform content policies, without prior notice.
